Terms of Use

These terms cover the use of strongandgrounded.com and the coaching and training I offer through it.

Welcome. These Terms of Use ("Terms") govern your use of www.strongandgrounded.com (the "Site"), operated by Jaymee Alpert Coaching, LLC, doing business as Strong and Grounded and Neshama Body and Soul ("we," "us," or "our"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

Use of the Site

You may use the Site for your own personal, informational, and non-commercial purposes. You agree not to use the Site in any way that is unlawful, harmful, or that interferes with anyone else's use of it, and not to attempt to gain unauthorized access to any part of the Site.

 

Intellectual Property

All content on the Site, including text, graphics, logos, images, session names, program frameworks, teachings, and written materials, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, reproduce, republish, or distribute our content without our written permission. You are welcome to share links to the Site.

 

Health and Physical Activity Disclaimer

Please read this section carefully. Our work involves physical exercise.

Strength training carries inherent risk, including the risk of muscle soreness, strains, sprains, injury, aggravation of an existing condition, and, in rare cases, serious injury or a medical event. By participating in any strength training session, group class, retreat, or workout program we provide, whether in person or over video, and by using any workout, exercise, or movement described on this Site, you acknowledge and accept those risks.

  • Talk to your doctor first. You should consult a physician or qualified healthcare provider before beginning any new exercise program, especially if you are pregnant or postpartum, are recovering from injury or surgery, or have any cardiovascular, orthopedic, neurological, or other medical condition. Nothing on this Site is medical advice, a diagnosis, a treatment plan, or physical therapy.

  • Tell us what we need to know. You agree to give us accurate information about your health, injuries, limitations, and medications, and to tell us if anything changes.

  • Listen to your body and stop. You are responsible for working within your own limits. If you feel pain, dizziness, shortness of breath, or anything that concerns you, stop immediately and seek medical attention if needed. Discomfort in a muscle is normal. Pain in a joint is a signal to stop.

  • Remote sessions have limits. Sessions delivered over Zoom or another video platform mean we cannot physically spot you, adjust your position by hand, or fully see your surroundings. You are responsible for exercising in a safe, clear space, with equipment that is in good condition and appropriate for you, and for calling emergency services yourself if a situation ever requires it.

  • In-person and hosted programs. For programs held at a gym, synagogue, camp, retreat center, or other venue, that venue is responsible for the safety and condition of its own facility and equipment. Additional waivers or terms from the host organization or facility may apply, and those are separate from these Terms.

Coaching and Content Disclaimer

Our life coaching, and all content on this Site, is offered for personal growth and development. It is not a substitute for, and should not be treated as, medical, mental health, psychological, therapeutic, nutritional, legal, or financial advice. Coaching is not therapy or counseling, and a coach is not a licensed mental health professional. If you are experiencing a medical or mental health condition or crisis, please consult a qualified licensed professional. If you are in immediate danger, call 911 or your local emergency number.

 

Our work is a collaborative partnership. You are responsible for your own choices, decisions, and actions. While we bring real experience and genuine care to this work, we cannot and do not guarantee any specific outcome or result, including any particular change in strength, weight, body composition, mood, clarity, or life circumstance. Change takes time, commitment, and active participation. Results vary from person to person.

 

We say plainly what our programs are designed to do. Three months of consistent work is enough to get started and see real change. It is not enough to overhaul a life, and we don't claim otherwise.

Jewish Content and Pastoral Context

Jaymee Alpert is an ordained rabbi, and Jewish text, prayer, and reflection are part of Neshama Body and Soul and are available within Strong and Grounded in whatever measure a client wants. This content is offered as teaching and personal practice. It is not a halachic ruling, a rabbinic decision for your community, or a substitute for guidance from your own rabbi or clergy. It is also not pastoral counseling in place of clinical mental health care. You are always welcome to participate as much or as little as feels right to you, and you do not need to be Jewish to work with us.

 

Testimonials and Examples

Any testimonials, stories, or examples shared on the Site reflect individual experiences. They are not a promise or guarantee that anyone else will have the same experience or achieve the same results.

 

Programs, Scheduling, and Payment

Details of any paid program, including its length, what it includes, the fee, and the payment schedule, are set out in the separate client agreement or booking confirmation you receive before the work begins. That agreement governs the program itself. These Terms govern your use of this Site. If the two ever conflict on a program question, the client agreement controls.

 

Links to Other Websites

The Site may contain links to third-party websites or resources that we don't control, including social media platforms and the websites of organizations that host our programs. We provide these for convenience only and are not responsible for their content, products, or practices.

 

Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising out of your use of the Site, your reliance on its content, or your participation in any exercise, workout, or program described on it. The Site and its content are provided "as is," without warranties of any kind, express or implied.

Assumption of Risk and Release

To the fullest extent permitted by law, and in consideration of being permitted to participate, you voluntarily assume all risks associated with physical exercise and release us from claims arising out of your participation, except for claims arising from our gross negligence or willful misconduct. This paragraph applies to your use of the Site and any workout content on it. Participation in a paid program or an in-person session may also require you to sign a separate waiver and release.

Indemnification

You agree to indemnify and hold harmless Jaymee Alpert Coaching, LLC, Strong and Grounded, and Neshama Body and Soul from any claims or demands arising out of your misuse of the Site or your violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of New York and Washington, without regard to its conflict-of-laws principles. Any disputes will be handled in the state or federal courts located in New York and Washington.

 

Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted, and we will revise the "Last updated" date above. Your continued use of the Site means you accept the updated Terms.
